Popular lawyer Ahmednassir Abdullahi has confirmed that he will not bow to pressure by Chief Justice Martha Koome who wants him to appear before the Judicial Service Commission to answer to questions over alleged corruption reports, he has consistently been attacking the Judiciary for.
The seasoned lawyer said that he will not cooperate claiming that the anticipated investigations are biased. He confirmed that he will only do so when at least four judges including Martha Koome are investigated over corruption.
” I will not cooperate!!! I will only cooperate if the investigation also touches on the 7 judges (or at least 4) of the Supreme Court …including CJ Koome. That is the only time I will share my files on JurisPESA,” affirmed the lawyer.
Martha Koome while giving her statement on integrity of the Judiciary, confirmed that some cases touching the Judiciary staff have been concluded, and now wants Ahmednassir to provide evidence for the conclusion of his never-ending accusation of the Judiciary over bribery.
“Regrettably, the persistent allegations highlighted on the social media platform X ( formerly Twitter) by Mr. Ahmednassir Abdullahi, SC do not identify the judge (s) alleged to be involved in corruption or the purported intermediaries collecting bribes on their behalf,” read part of the letter.
The Chief Justice directed the Secretary of the JSC to deploy a team within the Judiciary to investigate the matter with Ahmednassir, in order to detail the public about the allegations.
“In this regard, and to responsibly afford the public, the Judiciary and the member of the legal profession an opportunity to have full particulars of the accusations, I have directed the Secretary of the Judicial Service Commission to deploy and investigative team, drawn from JSC to engage with Ahmednassir Abdullahi, SC with a view of obtaining particulars of the allegations made on social media platform X with a view of progressing the complains.”
“I ask Ahmednassir Abdullahi, SC to cooperate with officers from the JSC if indeed the allegations made are in good faith and with a view to ensuring the Judiciary operates in an open and transparent manner for the benefit of all Kenyans,” continued the letter.
In the investigations, the Chairperson of the Law Society of Kenya, the Council of LSK, the Chairperson of the Senior Counsel Bar, representative members of the Senior Counsel Bar, Heads of Courts and members of the JSC have all been invited.
The 49th and former Chairperson of LSK, Nelson Havi, have criticised Koome for invited the above personalities and groups, claiming that they are part and parcel of the JSC and cannot make complaints.
“The Chairperson of Senior Counsel Bar and representative members of Senior Counsel Bar are Ivy Leaguers who do make complaints against Judges before JSC or at all. They settle with the judiciary “without noise.” How will they be of help on complaints against the CJ and Judges?” Asked Havi.
On January 18, 2024, the Supreme Court banned Ahmednassir Abdullahi from appearing before it due to his consistent attack on judges and the Judiciary.
“It is the decision of this Court, that henceforth and from the date of this Communication, you shall have no audience before the Court, either by yourself, through an employee of your law firm, or any other person holding brief for you, or acting pursuant to your instructions,” read the letter.
